What Is an Obligation to Leave French Territory (OQTF)?

An obligation to leave French territory (OQTF) is a decision issued by the prefecture requiring a foreign national to leave France. It may include a voluntary departure period of 30 days or be immediately enforceable.

An OQTF is often accompanied by additional measures that may significantly affect your situation, including:

  • A re-entry ban (IRTF), which may prevent return to France and the Schengen area for up to five years
  • House arrest measures, including reporting obligations and restrictions movement
  • Designation of the country of return
  • Placement in administrative detention (CRA) pending removal

Deadlines for challenging an OQTF are short and strictly enforced. Once these deadlines have passed, appeals are not possible any more and the removal measure may be enforced at any time.

Our Intervention

The firm handles all litigation relating to removal measures:

  • Appeals against OQTF decisions before the administrative court, whether or not a voluntary departure period has been granted
  • Appeals against re-entry bans (IRTF)
  • Challenges to house arrest measures
  • Urgent interim relief proceedings (référé suspension) to suspend the effects of the removal measure
  • Challenges to Schengen alerts (SIS database)
  • Appeals before the Administrative Court of Appeal in the event of an unfavourable first-instance decision

We assess your situation as a whole-length of stay in France, family ties, employment situation, health condition, and risks in the event of return - in order to build the strongest possible defense.

Asylum Seekers and OQTF

A rejection of an asylum application-by OFPRA or the CNDA-is often followed by an OQTF. In such cases, the firm can intervene on both the removal aspect and assess alternative pathways for regularisation, including exceptional admission to stay on the basis of private and family life, regularisation through employment, or residence permits on medical grounds.

Magda El Haitem regularly assists asylum seekers in collaboration with associations and reception centres (CADA). Her expertise covers the entire asylum process: preparation of OFPRA applications, assistance during interviews, appeals before the CNDA, and defense in the event of removal measures following a rejection.
